GENERAL TERMS

1.1 These Terms of Use (hereinafter referred to as the "Terms"), set out (1) the procedure for the use of the website and online shop pingpongshop.eu (https://pingpongshop.eu) (hereinafter - pingpongshop.eu) and (2) the legal relationship between the Buyer and the Seller.

1.2 Firma Bauska Ltd, single registration number 40003043711, registered office at Riga, Alauksta 3-7, LV-1009, Latvia, tel. +371 29541203 (hereinafter - the Seller), provides the content available on pingpongshop.eu and provides services in accordance with these Terms.

1.3 For the purposes of these Terms and Conditions, the Buyer is a natural person with legal capacity who shops at pingpongshop.eu or uses other pingpongshop.eu services, or a legal entity. These Terms and Conditions shall be binding on each Buyer regardless of whether the Buyer creates a user account on the Website.

1.4 The right to shop at pingpongshop.eu is reserved to natural persons who have the legal capacity to act, i.e. persons who have reached the age of majority and whose legal capacity is not limited by a court, and to legal persons.

1.5 If the buyer wishes to enter into a cooperation agreement with Firma Bauska Ltd. in order to receive additional discounts on purchases and special offers, he/she should contact one of our managers or send an e-mail to info@pingpongshop.eu.


1.6 If the Buyer orders and purchases goods and services offered by the pingpongshop.eu online shop and uses other services of pingpongshop.eu, the Buyer shall be deemed to have read and accepted the terms of the distance agreement without any objection and shall be bound by them.

1.5.1. The Distance Contract (hereinafter referred to as the "Contract") is concluded between the Seller and the Buyer who places an order and makes a purchase at pingpongshop.eu. The Contract shall come into force when the Buyer has placed an order by means of distance communication and has received confirmation of the order from the Seller by electronic mail. The order and the acknowledgement of receipt shall be deemed to have been received when they are accessible to the person to whom they are addressed. The Contract shall remain in force until fulfilment, i.e. payment of the order and delivery of the goods. The Contract applies to all orders and purchases made through the pingpongshop.eu online shop.

1.5.2 The Seller does not store the concluded Contracts for goods and services purchased at pingpongshop.eu, they are available on the Seller's website.

1.6 The Seller reserves the right to unilaterally amend and supplement the Terms and Conditions at any time without notice by publishing them on the pingpongshop.eu website, but notifying the publication of new Terms and Conditions on the website via the customer's registered e-mail address. The Customer shall be bound by the Terms in force at the time of ordering the goods and services. The Customer is obliged to read the Terms and Conditions of pingpongshop.eu before each purchase and has the option to save them on a permanent medium or print them.

1.7 The Buyer shall not be entitled to use the services of the pingpongshop.eu Online Shop if he/she has not read the Terms and Conditions or does not agree to them.

1.8 If the Buyer does not comply with the Terms, the Seller has the right to cancel or restrict the Buyer's access to pingpongshop.eu.

1.9 The Seller has the right to temporarily restrict access to pingpongshop.eu or to suspend the operation of the pingpongshop.eu online shop, by posting a notice on pingpongshop.eu or without notice.


PRODUCT CHARACTERISTICS AND PRICES

2.1 The prices of goods and services on pingpongshop.eu are quoted in Euro inclusive of value added tax (VAT). The price of the goods does not include delivery charges.

2.2 The Seller reserves the right to unilaterally change the range of goods, prices, special prices for goods and services at any time without notice. Goods and services shall be sold at the prices prevailing at the time the order is placed. The stock of goods is informative and shall be updated periodically.

2.3 The Seller reserves the right to unilaterally change the specifications of the Goods at any time without notice. The specifications of the goods shall be based on the information and pictures provided by the manufacturers.

2.4 The colour, size, shape or other characteristics of the goods shown in the pictures on pingpongshop.eu may differ from the actual characteristics of the goods. The images are for information purposes only.


ORDERING AND PAYMENT

3.1 Only Registered and Non-Registered Customers may order and purchase goods and services offered in the pingpongshop.eu online shop. If the Customer creates a user account on pingpongshop.eu, the Customer has the opportunity to join the loyalty programme of Firma Bauska Ltd.

3.2 In order to purchase goods in the online shop pingpongshop.eu, the following steps must be taken:

3.2.1. select the product (or products) by adding it to the "Shopping cart",

3.2.2. after all the selected products have been added to the "Shopping cart", click on "Checkout";

3.2.3. After filling in all the required data fields and confirming the order, your order will be processed and you will be contacted by an employee of Firma Bauska Ltd. to clarify the order details, if necessary. You will then receive an invoice to the email address you have provided.

3.3 Upon full payment of the invoice, your order will be processed.

3.4 The Seller has the right to refuse to sell the goods ordered by pingpongshop.eu by informing the Buyer if:

3.4.1. the goods are not available in the Seller's stock at all, or are not available in the quantity ordered;

3.4.2. the price and parameters of the goods do not correspond to the actual information about the goods, due to a technical error in the system.

3.4.3. the Buyer has not read the Terms and Conditions of pingpongshop.eu.

3.6 An order shall be deemed binding upon the Buyer and the Seller at the time when the Buyer has placed the order and has received confirmation from the Seller by electronic mail. The order and the acknowledgement of receipt shall be deemed to have been received when the person to whom they are addressed has access to them.

3.8 The Buyer is obliged to verify the information and data provided in the order. In case of any discrepancy in the information and/or data, the Buyer shall inform the Seller via Firma Bauska Ltd customer service e-mail address: info@ pingpongshop.eu. The Buyer may save the order and the confirmation of its receipt on a permanent medium or print it out.


DELIVERY (COLLECTION)

4.1 The Buyer shall receive the goods ordered in the online shop pingpongshop.eu at Firma Bauska Ltd. Alternatively, the Seller shall deliver the goods to the delivery address specified in the Buyer's order, if this was agreed at the time of placing the order and payment for delivery has been made. If the goods are not available in the Seller's warehouse, the parties agree on the time of delivery. The Seller shall inform the Buyer of the availability of the goods before payment of the order. The Buyer shall pay for the order only if it agrees to the delivery terms.

4.2 No later than within 3 (three) working days after the availability of the goods has been confirmed for the goods specified in the Buyer's order and payment for delivery has been received in full in the Seller's account, the Seller shall prepare the goods for delivery to the Customer and notify the courier of the delivery of the goods.

4.3 The Goods may be collected only if the order has been paid for in full.

4.4 Before collecting the goods at the warehouse of Firma Bauska Ltd, the Customer must present a personal identification document - passport or ID card or driving licence, as well as the order number or order confirmation. Goods shall be delivered only to the Buyer whose details are specified in the relevant order. If the Buyer fails to produce an order number or order confirmation or identity document, the Seller shall have the right not to issue the Goods.

4.5 The Buyer shall receive the goods at Firma Bauska Ltd. store within 14 (fourteen) days, unless otherwise stipulated by the laws and regulations. The time limit for receipt of the goods shall be counted from the date of sending a notification of receipt of the goods to the Buyer's e-mail address or from the date of sending such a notification by SMS.

4.6 If the Buyer fails to receive the Goods within the time limit set out in clause 4.5, the Buyer shall be deemed to be in breach of the Contract. In this case, the Seller shall be entitled to unilaterally withdraw from the Contract and require the Buyer to reimburse the Seller for additional expenses incurred by the Seller in connection with the goods (e.g.: expenses related to storage of the goods, etc.). The Seller shall refund to the Buyer the amount paid for the Goods, less any additional expenses incurred by the Seller.

4.7 The Goods shall be handed over to the Buyer in accordance with a delivery note signed by the Buyer and a representative of the Seller. The order shall be deemed to have been fulfilled upon receipt of the goods and signature of the said documents. The Seller shall inform the Buyer of the fulfilment of the order by sending a notification using the Buyer's e-mail address or by sending an SMS.



CANCELLATION AND CHANGES TO THE ORDER

5.1 In order to cancel an order or make changes to an order, the Buyer must contact the customer service of Firma Bauska Ltd by e-mail: info@ pingpongshop.eu



RETURN OF GOODS

6.1 The Buyer may exercise the right of withdrawal and unilaterally withdraw from the goods purchased in the online store pingpongshop.eu within 14 (fourteen) days and return them to the Seller. The period for exercising the right of withdrawal shall be calculated (1) from the date on which the Buyer or a third party, other than the carrier, designated by the Buyer, has taken possession of the goods; (2) from the date of conclusion of the contract in the case of the provision of a service.

6.2 The Buyer must inform the Seller of its decision to withdraw from the Contract before the expiry of the withdrawal period by:

6.2.1. any express notice of the decision to withdraw from the Contract, where the Buyer specifies:

6.3.1. the date on which the order was placed;

6.3.2. the date on which the Goods were taken into possession;

6.3.3. the name of the Buyer;

6.3.4. the exact name of the goods.

6.3.5 Proof of payment

6.4. The Buyer shall return the goods to the Seller without undue delay, but no later than 14 (fourteen) days after having sent the Seller the withdrawal form or the notice of exercise of the right of withdrawal. The time limit shall be complied with if the goods are returned before the expiry of the 14 (fourteen) day period.

6.5 The Seller shall, without undue delay, but no later than within 14 (fourteen) days from the date of receipt of the Buyer's notification of the decision to withdraw from the Contract, refund to the Buyer the amount paid by the Buyer. The Seller shall reimburse the said amount using the same type of means of payment used by the Buyer, unless otherwise agreed between the Buyer and the Seller.

6.6 The Seller shall be entitled to withhold repayment of any monies paid by the Buyer until the Seller has received the goods or the Buyer has provided the Seller with proof that the goods have been returned.

6.7 Where the Buyer has expressly chosen a method of delivery other than the cheapest standard delivery method offered by the Seller, the Seller shall not be obliged to reimburse the Buyer for any additional delivery costs.

6.8 The Buyer shall bear the Buyer's direct costs of returning the goods.

6.9 The Buyer shall hand over the Goods in their original packaging, in the same condition in which they were received, together with the accompanying documents - warranty card (if any), instructions for use and other documents and parts related to the Goods. You must ensure that the returned Goods are unused, undamaged and in their original packaging. If the returned Goods do not comply with the above requirements, the Buyer shall not be entitled to withdraw from the Contract and the Seller shall not be obliged to refund to the Buyer the amount paid for the Goods in question. If the Buyer is not entitled to withdraw from the Contract but has nevertheless returned the Goods to the Seller, the Seller shall re-deliver the Goods to the Buyer by the means of delivery chosen at its discretion and the Buyer shall bear the cost of delivery.

6.10 The right of withdrawal shall not apply:

6.10.1. the delivery of Goods which are made to the Buyer's specifications or are clearly personalised;

6.10.2. the delivery of goods which are perishable or about to expire;

6.10.3. the delivery of sealed goods which are not suitable for return for health or hygiene reasons and which have been opened after delivery;

6.10.4. the delivery of goods which, by their nature, have become irretrievably mixed up with other goods after delivery;

6.10.5. the delivery of goods or services the price of which depends on fluctuations in the financial market which are beyond the Seller's control and which may occur during the cancellation period;

6.10.6. for service contracts after the service has been performed in full, where performance has commenced with the Buyer's prior express consent and with the acknowledgement that he will lose his right of withdrawal once the Seller has performed the Contract in full;

6.10.7. in other cases provided for in the applicable laws and regulations.



CLAIMS FOR GOODS OR SERVICES NOT IN CONFORMITY WITH THE TERMS OF THE CONTRACT

8.1 Irrespective of the warranty provided by the manufacturer, if the Buyer is a natural person within the meaning of the Consumer Rights Law, the Buyer shall be entitled to submit a claim to the Seller for non-conformity of the goods with the terms of the Contract within 2 (two) years from the date of purchase of the goods or receipt of the service. The Buyer shall submit the claim to the Seller within 2 (two) months from the date of discovering the non-conformity of the goods or services with the terms of the contract. The procedure for filing and settling a claim for goods or services which do not comply with the terms of the contract shall be governed by the Law of 01.08.2006. 8.2 In cases where the goods are unsuitable for the Buyer due to size, colour, shape or other similar reasons, but are in conformity with the terms of the contract, the Buyer may not request that the goods be exchanged for other goods. As well as the exchange of goods, the Buyer cannot claim a refund if the goods are free from defects and damage but are simply not liked or needed.
